The privacy policy applies to using the web store at pood.dokfoto.ee (from now on referred to as the “Web Store”), to purchases made through it, and to the processing of data collected by the Juhan Kuusi Fond. The NPO Juhan Kuusi Fond manages the Web Store at Tuuleveski 24a, 10618, Tallinn, Estonia.

Validity of the Sales Contract, Goods, and Price Information

The terms of sale apply to purchases from the Web Store. The prices of products sold in the Web Store are indicated next to the products, and the currency is the euro. The price is subject to an additional charge for delivery. The delivery fee depends on the buyer’s location and delivery method. The delivery fee is displayed to the buyer upon placing the order. Information about the goods is provided directly next to the goods in the Web Store.

Ordering

To order goods, add the desired products to the cart. To complete the order, fill in the required data fields and select the preferred delivery method. The total amount, which can be paid via a bank link or other payment solutions, will be displayed on the screen. The contract becomes effective once the amount due has been received in the Web Store’s bank account. If the ordered goods cannot be delivered due to the goods being out of stock or for another reason, the buyer will be informed at the earliest opportunity, and the paid amount (including delivery costs) will be refunded immediately, but no later than 14 days from the date of the notification.

Delivery

The buyer bears the shipping costs; this information is displayed with the shipping method. Domestic shipments in Estonia generally reach the specified destination within 3-7 working days from the contract’s effective date. For deliveries outside Estonia, please contact directly toomas@dokfoto.ee.

Right of Withdrawal

After receiving the order, the buyer can withdraw from the contract made in the Web Store within 14 days. This right does not apply if the buyer is a legal entity. To use the 14-day return right, the ordered goods must not be used in any way other than necessary to ensure the nature, characteristics, and functioning of the goods, as allowed for testing the goods in a physical store. To return the goods, a withdrawal form must be filled out (available here) and sent to toomas@dokfoto.ee no later than 14 days after receiving the goods. The buyer bears the costs of returning the goods, except when the reason for the return is that the item returned does not correspond to what was ordered (e.g., a wrong or defective item). The buyer must return the goods within 14 days following the submission of the form or provide proof that they have handed the goods over to the carrier within this period. The Web Store will refund all fees received under the contract from the buyer immediately upon receiving the returned goods but not later than 14 days after receiving the cancellation notice. The Web Store may withhold refunds until the item which is the subject of the contract has been received back or until the buyer has provided proof of returning the item, depending on which occurs first. If the buyer has explicitly chosen a delivery method different from the least expensive type of standard delivery offered by the Web Store, the Web Store does not need to reimburse the additional cost exceeding the standard delivery cost. The Web Store has the right to withdraw from the sales agreement and demand the goods back from the buyer if the price of the goods in the Web Store is mistakenly marked significantly below its market price.

Right to Submit Claims

The Web Store is responsible for non-compliance or defects in the goods sold to the buyer that were present when handing over the item, which becomes apparent within two years from the delivery of the goods to the buyer. Within the first six months of handing over the item, it is assumed that the defect was present at delivery time. The obligation to prove otherwise lies with the Web Store. The buyer can contact the Web Store within two months of discovering the fault by emailing toomas@dokfoto.ee or by calling +372 5010777. The Web Store is not responsible for defects after delivering the goods to the buyer. If the goods purchased from the Web Store have defects for which the Web Store is responsible, the Web Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Web Store will refund the buyer all fees associated with the sales contract. The Web Store responds to the consumer’s complaint in writing or in a format that enables written reproduction within 15 days.

Dispute Resolution

If the buyer has complaints regarding the Web Store, they should email them to toomas@dokfoto.ee or call +372 5010777. If the buyer and the Web Store cannot resolve the dispute by agreement, the buyer may contact the Consumer Disputes Committee. The Consumer Disputes Committee is competent in resolving disputes arising from a contract between the buyer and the Web Store. The commission reviews the buyer’s complaint free of charge. The buyer may also use the European Union’s consumer dispute resolution platform.
